2. Services Provided

BoatCare BC provides scheduled visual inspections of your boat based on the service plan you select.

Inspections may include checking the general exterior condition of the boat, mooring lines, fenders, visible water levels, shore power connections, and other readily accessible areas. Where applicable, BoatCare BC may also take photographs and videos and provide an inspection report to the customer.

The specific checks performed may vary depending on the boat, marina access, weather conditions, and the service plan selected.

3. Nature and Limitations of the Service

BoatCare BC provides visual monitoring services only. Our inspections are not marine surveys, mechanical inspections, safety certifications, or professional assessments of the seaworthiness or mechanical condition of your boat.

BoatCare BC does not provide continuous or 24-hour monitoring and cannot guarantee the prevention or detection of theft, vandalism, water intrusion, mechanical failure, electrical failure, fire, weather-related damage, sinking, or other loss or damage.

Our service is intended to provide boat owners with periodic visual information about the apparent condition of their boat at the time of each scheduled inspection.

4. Customer Responsibilities

The customer is responsible for providing BoatCare BC with accurate and current information about the boat, marina location, slip number, emergency contacts, and any relevant access instructions.

The customer must ensure that BoatCare BC is authorized to access the boat and marina and must provide any keys, access codes, permits, or other permissions reasonably required to perform the scheduled inspections.

The customer is responsible for maintaining appropriate insurance coverage for the boat and its contents.

5. Marina Access and Restrictions

BoatCare BC services are subject to marina rules, access requirements, operating hours, security procedures, and any restrictions imposed by the marina or other property operator.

If access to the boat is temporarily unavailable due to marina restrictions, severe weather, unsafe conditions, emergencies, or circumstances beyond our reasonable control, the scheduled inspection may be delayed or rescheduled.

BoatCare BC will make reasonable efforts to inform the customer when a scheduled inspection cannot be completed as planned.

6. Urgent Issues and Emergencies

If BoatCare BC observes a condition during an inspection that appears to require urgent attention, we will make reasonable efforts to contact the customer or the emergency contact provided by the customer.

Where appropriate, we may also notify marina personnel or other relevant parties to help protect the boat, nearby property, or persons from immediate harm.

Unless separately authorized by the customer, BoatCare BC is not responsible for performing repairs or arranging professional repair services.

7. Payments, Subscriptions and Cancellation

BoatCare BC services may be offered on a recurring subscription basis. The applicable price, inspection frequency, and services included will be displayed when you select your service plan.

Subscription fees are charged according to the billing cycle selected by the customer. You are responsible for providing valid and current payment information.

You may cancel your subscription in accordance with the cancellation terms applicable to your service plan. Cancellation will stop future recurring charges but will not normally result in a refund for services already provided or for the current billing period, except where required by applicable law.

8. Photos, Videos and Inspection Reports

As part of the service, BoatCare BC may take photographs and videos and prepare inspection notes or reports documenting the apparent condition of the boat at the time of the inspection.

These materials are provided for informational purposes and reflect only what was reasonably visible and observable during the inspection. They should not be considered a marine survey, technical assessment, or guarantee of the condition of the boat.

Inspection reports, photographs, and videos are intended for the customer and persons authorized by the customer.

9. Limitation of Liability

BoatCare BC will perform its services with reasonable care. However, because inspections are periodic and visual in nature, BoatCare BC cannot guarantee that every problem, defect, hazard, or change in the condition of the boat will be identified or reported.

To the extent permitted by applicable law, BoatCare BC will not be responsible for loss or damage resulting from circumstances outside our reasonable control, including weather, theft, vandalism, mechanical or electrical failure, water intrusion, marina conditions, or events occurring between scheduled inspections.

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under applicable law.

10. Changes to Services and Terms

BoatCare BC may modify its services, service plans, pricing, or these Terms of Service from time to time.

Any material changes to these Terms will be posted on our website, and the “Last updated” date at the top of this page will be revised.

Changes will apply from the effective date of the updated Terms and will not affect rights or obligations that arose before that date, except where permitted by applicable law.

11. Governing Law

These Terms of Service are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada.

Any dispute relating to these Terms or the services provided by BoatCare BC will be subject to the jurisdiction of the courts of British Columbia, except where otherwise required by applicable law.
